Placerville, CA โ€“ September 12, 2025. Michah Lewis Wagener was sentenced to two years and eight months in local prison after pleading guilty to felony resisting an executive officerโ€”which means physically fighting with or using threats or force against law enforcement officers while they are performing their dutiesโ€”and felony vandalism, while also admitting aggravating factors.

The conviction stems from a series of incidents earlier this year. On August 4, 2025, Wagener was caught on video kicking and throwing rocks at a Placerville water spigot, causing it to break and shoot water into the air. The damage was estimated at about $1,500. He was arrested on August 13, 2025, at which time he already had three active warrants.

On June 26, 2025, a Placerville police officer attempted to arrest Wagener near the Hangtown Motel. Wagener resisted, pulling away and pushing the officer down a hill before fleeing. He was later confronted near a creek tunnel, where he continued to fight arrest before finally being handcuffed.

Earlier in the year, on February 12, 2025, Placerville police responded to reports of a man throwing chairs into the street near Bagel Works on Main Street. One chair struck a passing vehicle, though the driver chose not to press charges. Officers located Wagener nearby, and after resisting arrest again, he was restrained. He later admitted he had thrown the chairs because he was upset over a stolen backpack. Damages were estimated at about $1,000.

The case was heard in Department 2 of the El Dorado County Superior Court before the Honorable Judge Mark A. Ralphs.
